TERMS AND CONDITIONS

Please read these Terms and Conditions carefully before placing an order. By checking the tick box and purchasing goods from New Blood Art, you enter into a legally binding contract on the terms set out below. These terms affect your legal rights and obligations.

These are the standard Terms and Conditions of Sale of New Blood Art Ltd (company number 05118074) (“we”, “us”, “our”), trading as New Blood Art.

New Blood Art acts as agent for the artist unless otherwise stated. The contract for sale of the artwork is between you and the artist, with New Blood Art facilitating the transaction and certain obligations as set out below.

1. Interpretation

“Conditions” means these Terms and Conditions of Sale.

“Contract” means the contract for the sale of the Goods formed in accordance with these Conditions.

“Goods” means artworks offered for sale on the Website.

“Order” means your order submitted via the Website.

“Website” means www.newbloodart.com.

“Consumer” has the meaning given in the Consumer Rights Act 2015.

References to legislation include any amendments or replacements in force from time to time. 

2. Basis of Sale

2.1 All Orders are subject to acceptance by us. We reserve the right to decline any Order.

2.2 A Contract is formed only when we confirm acceptance of your Order by email.

2.3 Images and descriptions of artworks are provided for guidance. Due to the nature of original artworks, minor variations may occur.

3. Orders and Availability

3.1 All artworks are offered subject to availability.

3.2 If an artwork becomes unavailable after an Order is placed, we will inform you promptly and offer a refund or alternative where appropriate.

3.3 You are responsible for ensuring all Order details are accurate.

4. Price and Payment

4.1 Prices are shown in pounds sterling unless otherwise stated and include VAT where applicable.

4.2 Delivery, insurance, and packaging costs are charged separately and shown at checkout.

4.3 Payment must be made in full at the time of Order unless otherwise agreed in writing.

4.4 Payments are processed by third-party providers. We do not store payment card details. 

5. Delivery

5.1 Delivery will be made to the address provided in your Order.

5.2 Delivery times are estimates only. We will notify you if delays arise.

5.3 Risk in the Goods passes to you on delivery to the address provided.

5.4 Ownership of the Goods transfers only once full payment has been received.

6. International Orders

6.1 Buyers outside the UK may be subject to import duties, taxes, or customs charges. These are your responsibility and are not included in the purchase price. 

7. Returns, Damage, and Defects

7.1 You must inspect Goods promptly on delivery.

7.2 Any damage or defects must be reported within 48 hours of delivery.

7.3 Your statutory rights under the Consumer Rights Act 2015 remain unaffected.

8. Cancellation Rights

8.1 Consumers may have a 14-day cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, unless an exemption applies.

8.2 Due to the nature of original artworks, cancellation rights may not apply where artworks are bespoke, commissioned, or personalised.

8.3 Where cancellation rights apply, Goods must be returned in their original condition at your cost unless faulty. 

9. Intellectual Property

9.1 Copyright in all artworks remains with the artist.

9.2 Purchase of an artwork does not transfer copyright.

9.3 Images and content on the Website may not be reproduced without permission.

10. Limitation of Liability

10.1 Nothing in these Conditions limits liability for fraud, death, or personal injury.

10.2 We are not liable for indirect or consequential losses.

10.3 Our total liability shall not exceed the purchase price of the Goods.

11. Data Protection

11.1 This section describes our current data handling practices.

11.2 We process personal data in accordance with UK GDPR and our Privacy Policy.

11.3 By placing an Order, you consent to the processing of personal data for contract fulfilment, account administration, legal compliance, and legitimate business purposes. 

11.4 SMS Communications - where you provide a mobile telephone number, we may use SMS for operational communications such as order notifications, delivery updates, appointment reminders, or messages relating to incomplete or abandoned orders.

SMS marketing messages will be sent only where this functionality is enabled and where you have provided explicit consent in accordance with applicable law. Where consent is required, you may withdraw it at any time using the instructions provided in the message.

SMS communications, where used, may be delivered via third-party service providers acting on our instructions and subject to appropriate data protection obligations.12. Governing Law and Jurisdiction

These Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.  

13. General

13.1 If any provision is held invalid or unenforceable, the remaining provisions remain in force.

13.2 These Conditions constitute the entire agreement between you and us.
